A Manhattan grand jury has indicted convicted Colombo killer Joseph “Joey Cupcakes” Urgitano of gang assault for the Aug. 4 baseball bat-to-the-head beating of a Jersey man, prosecutors said today.
Urgitano and co-defendant Michael Groark, 46, and Louis Navarro, 29, are accused of beating the victim at West 14th St. and 9th Avenues so severely, that he lost consciousness and bled heavily from the head, according to the criminal complaint against them.
Urgitano was indicted despite being the victim of what was actually a six-on-three attack of the three defendants — and prosecutors refused to let three eyewitnesses testify before the grand jury on Urgitano’s behalf, his lawyer, Murray Richman, complained after the DA’s announcement.
“They have no connection to my client whatsoever and in my honest opinion they are extremely beneficial to my client,” Richman said. Urgitano is being held in lieu of $20,000 cash bail.
